TERMS OF USE
Use, digital access, purchases and intellectual-property terms.
These terms explain the service, permitted use, paid digital access and the limits of The Observer as an independent research tool.
1. Seller and operator
The Observer is a trade name registered in the Netherlands and is the seller/operator of observercatalyst.com.
KVK: 94591423
VAT ID: NL005093674B80
Business address: Vliestroom 159, 2401 VD Alphen aan den Rijn, The Netherlands
Customer support and privacy: easytradeadvice@gmail.com
2. Acceptance and permitted use
By using The Observer you agree to these terms. The service is for personal or internal research use unless separate written permission is granted. You may research catalysts and follow links to primary sources. You may not copy the service into a competing product, systematically extract proprietary output, circumvent access controls, or resell Observer data at scale.
3. Intellectual property and public-source data
The Observer reserves rights in its original software, interfaces, visual design, written summaries, scoring outputs, classification systems, data selection and arrangement, verification work, company/drug/event matching, proprietary mappings, database structure and presentation. Underlying public facts, regulator records, company names, trademarks and third-party materials remain the property of their respective owners.
Non-public weights, thresholds, normalization, matching logic, heuristics and implementation details are proprietary. Public explanations of model factors do not grant a licence to reproduce the underlying methodology.
4. No scraping or reverse engineering
Without written permission you may not use automated tools to systematically copy substantial portions of Observer data, reconstruct the database, bypass rate limits or paywalls, or deliberately reverse engineer non-public scoring weights, thresholds, mappings or implementation details, except where applicable law gives a right that cannot be waived.
5. Independent research tool — not investment advice
The Observer is informational and does not provide investment, financial, legal or medical advice. It does not recommend buying, selling or holding any security. Catalyst Sensitivity is a model-based research indicator for relative issuer/event materiality; it is not an approval probability, price target, expected return or forecast of price direction or magnitude.
6. Accuracy and availability
Coverage may be incomplete, delayed or incorrect. Dates, mappings, sources, scores and regulatory information can change. Users should verify material information against the linked primary source. The service may be modified, suspended or discontinued, and no online service can guarantee uninterrupted availability.
7. Accounts and free unlocks
Access entitlements are tied to the account that receives them. When offered, one free monthly unlock has no cash value and is subject to the limits shown in the service. An unlocked catalyst has no scheduled time-based expiry while that feature and the account remain available; this is not a promise that the service itself will exist forever.
8. Paid digital purchases
The public launch product is a one-time single-catalyst digital unlock. It is not a subscription. The customer-facing EUR price shown before checkout is the total price. Where tax applies and Stripe Tax is enabled, tax is calculated within that displayed total rather than added on top.
Confirmed payment unlocks the selected catalyst to the purchaser's account after server-side verification and Stripe confirmation. Additional purchase formats or prepaid credit packs may be introduced later only when they are shown as available in the service.
9. Immediate supply, withdrawal and refunds
Mandatory consumer rights remain unaffected. Before paid checkout begins, the purchaser must actively request immediate supply and acknowledge the consequences for the statutory withdrawal right that are stated in the applicable versioned Purchase Terms.
Duplicate charges, failed fulfilment, non-conforming digital supply and similar errors can be reported for investigation. A customer can submit an online cancellation/withdrawal request through the cancellation page. The EU model withdrawal form is also available. Receipt of a request does not by itself determine whether a refund or statutory withdrawal right applies.
10. Payments and confirmations
Stripe-hosted Checkout processes payment details, payment methods, fraud checks, tax calculation where enabled and receipts. The Observer does not store full payment-card numbers. Purchase and consent records needed for fulfilment, accounting, disputes and customer support are stored in the service backend. After confirmed payment, The Observer is designed to send a purchase confirmation to the purchaser's account email containing the transaction record and applicable consent version.
11. Complaints and support
Questions, complaints, payment/access problems and privacy requests can be sent to easytradeadvice@gmail.com or through the feedback form on the main site. We will review the issue and respond using the contact information supplied.
12. Governing law and mandatory rights
These terms are governed by Dutch law, without depriving consumers of mandatory protections that apply under the law of their country of residence. If a provision is unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.
13. Third parties and affiliations
The Observer may link to regulator, issuer and other third-party websites. It is not affiliated with, endorsed by or sponsored by the U.S. Food and Drug Administration, European Medicines Agency, European Commission, U.S. Securities and Exchange Commission, or displayed issuers unless explicitly stated otherwise.
